The below terms and conditions govern your access to and use of www.bluebirdcleaningco.com including any content, functionality, and services offered on or through the same (collectively, the “Website”). The Website is offered by Blue Bird Home Cleaning, LLC, an Indiana limited liability company (“Blue Bird”). 

Within this Terms of Use and Privacy Policy (the “Policy”), “you” are a User of the Website (as defined below), and “we”, “us”, or “our” refers to Blue Bird. Collectively, all users of the website may be referred to as “Users” herein. Unless otherwise noted, each section and provision of this Policy applies to all Users.  

Please read this Policy carefully to understand our policies and practices regarding the use of your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Website. By accessing or using the Website, you agree to this Policy. By using the Website, or by clicking to accept or agree to these terms when this option is made available to you, you accept the terms herein. If you do not want to agree to these terms, you must not access or use the Website.

You are also subject to any additional posted policies and rules related to specific services and features which may be presented to you at the time of accessing and/or using such services or features. All such policies are incorporated by reference into this Policy and made part of this Policy.

1. Accessing the Website. We reserve the right to withdraw or amend this Website in our sole discretion without notice. Your continued use of the Website means that you accept and agree to any and all changes. From time to time, we may restrict access to some parts of the Website, or the entire Website, to some or all Users. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. We have the right to disable your use of the Website in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of this Policy. 

1. General Use. You may use the Website solely for personal, non-commercial purposes to learn about Blue Bird’s services and history. Some Users may use the Website to book services. If you use the Website to contact us, you represent and warrant that the information provided to us is your current and correct personal contact information, or if you are contacting us on behalf of a business entity, you represent that you have the right to provide contact details for that business entity. You are prohibited from using the Website to provide contact information of any other person or entity. If we provide the option to create an account, you represent that all information provided to create such account will be true and accurate. You agree to update your account information if it changes. Accounts are personal to the User who creates such account, and you agree not to provide any third party access to any account you may have. 

2. Our Services. The information provided on the Website is general information only. We cannot guarantee the accuracy or completeness of any details regarding the services we offer, examples of our past work, or the history of our business as such details are provided via the Website. Nothing contained on the Website is, or should be construed to be, an offer to provide services to you. We encourage you to reach out to us to discuss your cleaning needs so that we may determine if Blue Bird is able to assist you. Whether or not you decide to hire Blue Bird or engage us for any services should be based on your direct conversations with our team, and not based on any information provided on the Website. Nothing contained on the Website should be construed as a potential outcome of the use of Blue Bird’s services. We disclaim all liability, direct or indirect, for any expectations (whether personal, business, or monetary) that any User may have resulting from the use of the Website and any information located thereon. 

Blue Bird has engaged a third party service provider, “Launch27”, to provide product offerings, appointment availability, booking forms, and pricing for services. The scope of services provided by Blue Bird will consist only of what service option is selected by you on the booking form at the time of booking. There will be no additional service options available outside of what is listed on the booking form and no additional services will be provided.  When using the Website to book an appointment with Blue Bird, you may be redirected to Launch27’s website and you may be required to create an account through Launch27. All individual appointment bookings, automatic or recurring appointment bookings or cancellations of bookings will be subject to Launch27’s terms of use. Launch 27 set forth its own terms of use and privacy policy, which Users are responsible for reading and understanding. As of the date of this policy, Launch27's general terms are available through www.launch27.com, but you are solely responsible for understanding the terms that are applicable to you regarding your use of Launch27. 

1. Customer Premises.  Blue Bird’s cleaning services require that Blue Bird be able to enter your premises.  You are not required to be present at the time Blue Bird provides cleaning services at your premises. If you will not be present at the time of cleaning services, you must email Blue Bird at least 24 hours in advance to (1) provide permission for Blue Bird to enter your premises; (2) provide the method for Blue Bird to gain access to and enter your premises; and (3) inform Blue Bird of any potential hazards or danger that could be present at your premises, including but not limited to, pets, people, alarm systems, etc.  You can contact Blue Bird by emailing us at hello@bluebirdcleaningco.com.  If Blue Bird is ultimately unable to enter your premises, the appointment will be canceled and the cancellation fee (as described below) will apply. 

2. Cancellation Policy for Services.  All Blue Bird services will be booked through Launch27’s website and/or booking form, as provided on the Website.  Please note that once you have booked an appointment with Blue Bird through Launch27’s website and/or booking form, it means that Blue Bird has reserved time in our schedule exclusively for you.  If you cancel your appointment less than 24 hours before it is scheduled to take place, you will be subject to a cancellation fee of 50% of the booking fee.  To avoid such cancellation fee, please provide cancellation notice at least 24 hours prior to your appointment. You can cancel or reschedule an appointment, or cancel recurring appointments, through the customer portal provided via the “Manage Appointments” link on the Website, or by going directly to https://bluebird.launch27.com/login.  

3. Payment Processing. A hold will be placed on the credit card provided in the days leading up to your booking.  Once the cleaning service is provided, your payment will be processed.  Blue Bird will not be processing payments for services. Launch27 will be processing payments for services. Launch27 will be responsible for administering and answering questions about policies regarding payment for services, automatic or recurring payments or refunds of payments.  Launch27 may use third party providers to process payments, and each third party may also set forth its own terms of use and/or privacy policies. You are responsible to view Launch27’s terms of use and/or any privacy policy and any third party provider’s terms of use and/or privacy policy for more information regarding payment processing.

4. Policies of Third-Party Sites. Except as otherwise discussed in this Policy, this document only addresses our Website and the use and disclosure of Information we collect from you. Other sites that may be accessible or linked through our Website have their own policies and data collection, use and disclosure practices. Please consult each third party site’s privacy policy and terms of use. We are not responsible for the policies or practices of third parties. 

1. Prohibited Uses. You may use the Website only for lawful purposes and in accordance with this Policy.  You agree not to use the Website in any way that violates any applicable federal, state, local, or international law or regulation; to impersonate or attempt to impersonate any other party; to introduce any viruses or other material that is malicious or technologically harmful; or to attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website or attack the Website in any way.  This Policy permits you to use the Website only for the purposes intended and not for any commercial use.

The Website and the entire contents, features, and functionality (including but not limited to all information, software, underlying code, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) associated therewith are owned by Blue Bird and are protected by United States intellectual property laws (including but not limited to copyright, trademark, and patent laws) and where applicable, international intellectual property laws. No right, title, or interest in or to the Website or any content on the Website is transferred to you. As between Users and Blue Bird, all right, title and interest in and to any intellectual property incorporated or used on the Website will remain solely with Blue Bird. The terms “Blue Bird”, “Blue Bird Home Cleaning”, “Blue Bird Cleaning Company”, “Blue Bird Home & Company”, and any logos, designs, or slogan related to such terms and phrases, are trademarks of Blue Bird (or our affiliated entities). 

1. The Information We Collect. We may collect certain information from you described in the categories below (collectively referred to herein as “Information”): 

1. Information by which you may be personally identified, such as your name, age, email address, telephone number, address, and zip code (collectively “Personal Information”);

Information regarding how the Website is accessed and used by you, including but not limited to your internet protocol address, browser type, browser version, the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, the content and advertisements you have accessed or seen, other diagnostic data, and tracking technologies such as cookies, web beacons, tags, and scripts, which may be collected directly through the Website or via third parties providing analytic services to us (“Usage Data”).

Usage Data is collected for every User of the Website. Personal Information is collected only when you provide it to us; however, if any Information is provided to Blue Bird in any manner by any User, this Privacy Policy will apply to such Information.

We may use and share your Personal Information with affiliated and non-affiliated organizations as necessary for business purposes as follows: (i) to our subsidiaries and affiliates, and to contractors, service providers, and other third parties affiliated with us in order to continue to develop, improve, and provide our Website to you (ii) as part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated; (iii) in response to legal process, court order, or government or regulatory request; or to enforce other agreements with you; (iv) with IT service providers (including IT platform provides and website analytic service providers) in order to provide the Website to you and to analyze your use of the Website; and (v) with our agents and other service providers, including Launch27, in order for the same to perform function on our behalf, such as hosting, billing, booking appointments, scheduling, notification, storage, content management, analytics, customer service, fraud protection, etc., in the course of the performance of a contract, on the basis of other legitimate interests, by legal obligation, or through your consent.

1. Age and Geographic Restrictions. This Website is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. The owner of the Website is based in the State of Indiana in the United States. We provide this Website for use only by persons located in the United States. By using the Website, you represent and warrant that you meet all of the foregoing eligibility requirements and if you do not, you must not access or use the Website. We make no claims that the Website or any of its content is accessible or appropriate outside of the United States. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

1. Opt-Out. We have the right to (i) take appropriate legal action, including without limitation, refer you to law enforcement, for any illegal or unauthorized use of the Website; and (ii) terminate or suspend your access to all or part of the Website for any or no reason, including without limitation, any violation of this Policy. We have the right to cooperate fully with any law enforcement authorities or court orders requesting or directing us to disclose the identity or other information collected from users of the Website, and you waive any claims against us for providing such information for such purposes. 

2. Entire Agreement. This Policy contains the entire agreement between Blue Bird and you as a User of the Website. No other communications, whether direct or indirect, between you and Blue Bird will, or are intended to, alter, or supersede any provision of this Policy. 

3. Waiver and Severability. No waiver by Blue Bird of any term or condition set out in this Policy shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Blue Bird to assert a right or provision under this Policy shall not constitute a waiver of such right or provision. If any provision of this Policy is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of this Policy will continue in full force and effect.

4. Disclaimer of Warranties. You understand that we cannot and do not guarantee or warrant that the Website will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL BLUE BIRD, ITS AFFILIATES, OR OUR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN ANY CASE, IF WE ARE FOUND LIABLE DESPITE THE ABOVE LIMITATION, OUR LIABILITY ARISING FROM OR RELATING TO THE PROVISION OR THE WEBSITE OR YOUR ACCESS OR USE OF THE SAME SHALL BE LIMITED TO $100.00.

You agree to defend, indemnify, and hold harmless Blue Bird, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Policy or your use of the Website.

We have put in place industry-standard procedures to safeguard and help prevent unauthorized access, to maintain data security, and to correctly use the information we collect online. Unfortunately, we cannot guarantee that 100% of the data transmissions are secure.
